It turns out that my favorite black actor right now Anthony Mackie, 36, is fighting a DUI case from 2013, arguing at his trial in Manhattan Criminal Court that cops had no right to arrest him..
The funny thing is the contradicting statement between the arresting officer and the officer who transported the actor to precinct.

According to Mackie's defense lawyer Mike Miller,
“It’s clear that the mere smell of alcohol and bloodshot eyes doesn’t give the officers justification to arrest him,”
Cops claimed the actor had bloodshot eyes and the smell of booze on his breath while in a tinted Dodge challenger, but refused a breathalyzer.
But the officer who transported Mackie to a precinct testified that the thespian had clear speech, polite demeanor and clean dress, contradicting the arresting cop’s observations, Miller argued Thursday.
Mackie is set to star in “Avengers: Age of Ultron” with Chris Evans, Scarlett Johansson and Robert Downey Jr.
